Terms of Service
These Terms of Service ("Terms") govern your access to and use of the TalentScout AI platform (the "Service"). By creating an account, starting a free trial, or purchasing a plan, you ("Client") agree to these Terms.
1. The Service
TalentScout provides AI-assisted candidate pre-qualification, including CV analysis, WhatsApp and AI voice interviews, DISC profiling, authenticity scoring and a Fraud Risk Score, delivered through a web dashboard. Features and limits depend on the plan selected.
2. Accounts
You are responsible for the accuracy of your account information and for keeping your credentials confidential. You are responsible for all activity under your account. You must notify us of any unauthorized use.
3. Free trial
We may offer a time-limited free trial. At the end of the trial, continued access requires selecting and paying for a plan. We may modify or discontinue trials at any time. Trials are intended for evaluation and may use sample data.
4. Plans, payment and taxes
Paid plans are billed monthly in advance in US dollars and renew automatically until cancelled. Prices, included candidate volumes and overage rates are shown at checkout and may change with notice. Applicable taxes depend on your country and are your responsibility. Candidates evaluated beyond your plan's included volume are billed as overage.
5. Cancellation and refunds
You may cancel at any time; access continues until the end of the current billing period. Except where required by law, payments are non-refundable and partial periods are not prorated.
6. Client responsibilities and candidate data
You are the controller of the candidate data you submit. You represent that you have a lawful basis and the necessary consents to process each candidate through the Service, and that you will comply with all applicable employment and data-protection laws. You will not use the Service to discriminate unlawfully or for any purpose prohibited by law.
7. Acceptable use
You will not misuse the Service, including: reverse-engineering it, reselling it without authorization, uploading unlawful content, attempting to breach security, or overloading the infrastructure. We may suspend accounts that violate these Terms.
8. AI outputs — no guarantee
Scores and reports, including the Fraud Risk Score, are generated by automated models and are provided as decision-support only. They may contain errors and are not a definitive assessment of any person. The Client is solely responsible for its hiring decisions. TalentScout does not guarantee any particular result and disclaims responsibility for decisions made based on the Service.
9. Intellectual property
The Service, software and branding are owned by TalentScout. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service. Your data remains yours; you grant us the rights needed to operate the Service.
10. Warranty disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, TalentScout will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to us in the three (3) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold TalentScout harmless from claims arising out of your use of the Service, your candidate data, or your breach of these Terms or applicable law.
13. Termination
We may suspend or terminate the Service for breach of these Terms or non-payment. Upon termination, your right to use the Service ends and we may delete your data after a reasonable period.
14. Changes and governing law
We may update these Terms; material changes will be notified and continued use constitutes acceptance. These Terms are governed by the laws of the jurisdiction in which TalentScout is established, without regard to conflict-of-law rules.

Términos y Condiciones
Estos Términos y Condiciones ("Términos") regulan el acceso y uso de la plataforma TalentScout AI (el "Servicio"). Al crear una cuenta, iniciar una prueba gratuita o adquirir un plan, tú ("Cliente") aceptas estos Términos.
1. El Servicio
TalentScout ofrece pre-calificación de candidatos asistida por IA, que incluye análisis de CV, entrevistas por WhatsApp y voz con IA, perfil DISC, puntajes de autenticidad y un Fraud Risk Score, entregados a través de un panel web. Las funciones y los límites dependen del plan seleccionado.
2. Cuentas
Eres responsable de la exactitud de la información de tu cuenta y de mantener la confidencialidad de tus credenciales. Eres responsable de toda actividad realizada bajo tu cuenta y debes notificarnos cualquier uso no autorizado.
3. Prueba gratuita
Podemos ofrecer una prueba gratuita por tiempo limitado. Al finalizar la prueba, para seguir usando el Servicio deberás seleccionar y pagar un plan. Podemos modificar o suspender las pruebas en cualquier momento. Las pruebas son para evaluación y pueden usar datos de ejemplo.
4. Planes, pago e impuestos
Los planes de pago se facturan por adelantado de forma mensual en dólares estadounidenses y se renuevan automáticamente hasta su cancelación. Los precios, los volúmenes de candidatos incluidos y las tarifas por excedente se muestran al momento de la compra y pueden cambiar con previo aviso. Los impuestos aplicables dependen de tu país y son tu responsabilidad. Los candidatos evaluados por encima del volumen incluido se cobran como excedente.
5. Cancelación y reembolsos
Puedes cancelar en cualquier momento; el acceso continúa hasta el final del período de facturación en curso. Salvo que la ley exija lo contrario, los pagos no son reembolsables y los períodos parciales no se prorratean.
6. Responsabilidades del Cliente y datos del candidato
Eres el responsable del tratamiento de los datos de candidatos que envías. Declaras que cuentas con una base legal y los consentimientos necesarios para procesar a cada candidato mediante el Servicio, y que cumplirás toda la normativa laboral y de protección de datos aplicable. No usarás el Servicio para discriminar de forma ilegal ni para fines prohibidos por la ley.
7. Uso aceptable
No harás mal uso del Servicio, incluyendo: aplicar ingeniería inversa, revenderlo sin autorización, subir contenido ilícito, intentar vulnerar la seguridad o sobrecargar la infraestructura. Podemos suspender cuentas que incumplan estos Términos.
8. Resultados de IA — sin garantía
Los puntajes e informes, incluido el Fraud Risk Score, son generados por modelos automatizados y se proporcionan solo como apoyo a la decisión. Pueden contener errores y no constituyen una evaluación definitiva de ninguna persona. El Cliente es el único responsable de sus decisiones de contratación. TalentScout no garantiza ningún resultado en particular y se exime de responsabilidad por las decisiones tomadas con base en el Servicio.
9. Propiedad intelectual
El Servicio, el software y la marca son propiedad de TalentScout. Estos Términos te otorgan un derecho limitado, no exclusivo e intransferible de uso del Servicio. Tus datos siguen siendo tuyos; nos otorgas los derechos necesarios para operar el Servicio.
10. Exención de garantías
El Servicio se proporciona "tal cual" y "según disponibilidad", sin garantías de ningún tipo, expresas o implícitas, incluidas las de comerciabilidad, idoneidad para un fin particular y no infracción, en la máxima medida permitida por la ley.
11. Limitación de responsabilidad
En la máxima medida permitida por la ley, TalentScout no será responsable por daños indirectos, incidentales, especiales, consecuentes o punitivos, ni por lucro cesante, pérdida de ingresos, datos o reputación. Nuestra responsabilidad total agregada relacionada con el Servicio no excederá los montos que nos pagaste en los tres (3) meses anteriores al hecho que origina el reclamo.
12. Indemnización
Aceptas indemnizar y mantener indemne a TalentScout frente a reclamos derivados de tu uso del Servicio, de tus datos de candidatos o de tu incumplimiento de estos Términos o de la ley aplicable.
13. Terminación
Podemos suspender o terminar el Servicio por incumplimiento de estos Términos o falta de pago. Al terminar, cesa tu derecho a usar el Servicio y podremos eliminar tus datos tras un período razonable.
14. Cambios y ley aplicable
Podemos actualizar estos Términos; los cambios sustanciales se notificarán y el uso continuado implica su aceptación. Estos Términos se rigen por las leyes de la jurisdicción en la que TalentScout esté constituida, sin atender a las normas de conflicto de leyes.
